An internet user recently wrote to us:<\/p>\n

\u201cMy father was a donor in the 2000s. Is there any way for his biological children to find him if they feel the need?\u201d<\/p>\n<\/blockquote>\n

This question touches on a subject that is both intimate and deeply human. And it turns out that, recently, the law has (somewhat) evolved. <\/p>\n

\n

\u2696\ufe0f What French Law Says<\/strong><\/h3>\n

For a long time, sperm or egg donation in France was strictly anonymous and free<\/strong>. No filiation link, no identity information could be transmitted. <\/p>\n

But the bioethics law of August 2, 2021<\/strong>, which came into effect on September 1, 2022, changes the situation:<\/p>\n

  • \n

    Children born from donations made after this date<\/strong> can request the donor’s identity<\/strong> (name, first name, age, city, etc.), if the donor has given consent<\/strong> at the time of donation.<\/p>\n<\/li>\n

  • \n

    However, donations made before 2022 remain subject to the anonymity regime<\/strong>, unless<\/strong> the donor voluntarily contacts the authorities to lift this anonymity<\/strong>.<\/p>\n<\/li>\n<\/ul>\n

    \ud83d\udc49 So for a donation from the 2000s:<\/strong>
    \u27a1\ufe0f No information can be transmitted<\/strong> to children born from this donation, unless the donor takes voluntary action<\/strong> for recognition or partial lifting of anonymity.<\/p>\n

    \ud83e\udded What Steps are Possible Today?<\/strong><\/h3>\n

    \u2705 for Children Born from a Donation before 2022:<\/em><\/h4>\n
      \n
    1. \n

      They can \u201cregister on an origins access registry<\/strong>\u201d with the CNAOP<\/strong> (National Council for Access to Personal Origins), even if this registry mainly concerns adoptions.<\/p>\n<\/li>\n

    2. \n

      In case of suffering or need for answers, a request for psychological support<\/strong> can be made to AMP (Assisted Medical Procreation) centers.<\/p>\n<\/li>\n

    3. \n

      If the donor comes forward, a voluntary cross-checking of requests<\/strong> may possibly be established.<\/p>\n<\/li>\n<\/ol>\n

      \u2705 for Donors from the 2000s who Wish to be Found:<\/em><\/h4>\n
        \n
      1. \n

        It is possible to contact the CECOS<\/strong> (Center for Study and Conservation of Eggs and Sperm) where the donation was made.<\/p>\n<\/li>\n

      2. \n

        A voluntary declaration to lift anonymity<\/strong> can be registered with the National Register of Gamete Donations<\/strong>.<\/p>\n<\/li>\n<\/ol>\n

        \ud83e\uddec a New Era for Children Born from Donations?<\/strong><\/h3>\n

        Society is evolving. New laws aim to better reconcile the donor’s right to anonymity with the child’s right to identity<\/strong>. More and more children who have become adults express this existential need: to know where they come from. <\/p>\n

        Tools like JeTeRecherche<\/strong> or commercial DNA tests abroad (23andMe, MyHeritage…) sometimes bypass legal frameworks, but they show a reality: the need for truth and roots is universal<\/strong>.<\/p>\n
